Terms of Use

The terms that apply when you use this website.

Important: legal details pending verification. Do not publish this website until the legal operator and controller identity, contact address, actual data processing arrangements and retention practices have been confirmed. These policies require review against those facts before publication.

1. About Forma Digital and these terms

Forma Digital is a trading name used by an agency providing app development, business software and AI automation services across the UK. These terms concern use of the website at formadigital.uk; they are not a project contract.

Legal website operator identity: To be confirmed before publication.
Operator contact address: To be confirmed before publication. The actual person or legal entity operating the site must be identified and these terms checked against that identity before publication.

These terms explain permitted website use and the responsibilities associated with it. Nothing here removes statutory rights that cannot lawfully be excluded, including applicable consumer rights.

2. Website information, enquiries and proposals

Website information describes services and potential approaches in general terms. It is not an offer to enter a contract, a binding quotation or advice tailored to your circumstances. Suitability, scope, cost and timescales depend on the requirements of the particular project and discussion with you.

Submitting an enquiry, requesting a consultation or receiving an acknowledgement does not create a project contract or confirm a scheduled appointment. Any consultation arrangements must be agreed separately. Examples and case studies do not guarantee that another project will achieve the same outcome.

Publication of native apps on the Apple App Store or Google Play is subject to the relevant platform's review and approval. Website descriptions do not guarantee approval, publication or continuing availability on those platforms.

3. Separate project agreements

Paid work is subject to a separate written agreement with the confirmed contracting party. That agreement should set out scope and deliverables, fees and payment terms, responsibilities, any dependencies, timescales, acceptance arrangements, intellectual property, support and relevant data protection obligations.

These website terms do not replace that agreement or establish pricing, service levels, ownership of commissioned work or ongoing support commitments. Where a signed project agreement addresses the same matter, its provisions govern the project, subject to applicable law.

4. Permitted use

You may browse the site and use its enquiry facilities for genuine, lawful purposes. Please provide accurate information to the best of your knowledge and submit only information you are entitled to share.

You must not knowingly introduce malicious code, attempt unauthorised access, interfere with the site's operation, circumvent its security or anti-spam checks, impersonate another person or use the enquiry form for spam or unlawful material. Do not use automated activity in a way that causes disruption or disproportionate load.

Where reasonably necessary to address misuse or a security risk, access may be restricted. Any response should be proportionate to the issue and must respect applicable law.

5. Intellectual property

Rights in the website's content, branding, design and software remain with their respective owners or licensors. Third-party names and marks remain the property of their owners; their appearance does not itself imply endorsement or a partnership.

You may view the site and download or print reasonable extracts for your own reference when considering our services, retaining relevant ownership notices. Other reproduction, redistribution or commercial reuse requires the relevant rights holder's permission unless permitted by law. You must not present our material as your own or imply an endorsement that has not been agreed.

Ownership and licensing of material created for a client project are determined by the separate written project agreement, not by these website terms.

6. Third-party websites and services

External links are provided for relevant information or convenience. Independently operated sites and services have their own terms and privacy practices. We do not control their content, availability or changes, and linking to them is not a guarantee of their suitability.

Consider the relevant provider's terms before using a third-party service or supplying information to it. This does not exclude any responsibility that the law places on us for our own actions.

7. Availability and changes

We aim to keep the website useful and accurate, but uninterrupted access, error-free content and compatibility with every device cannot be guaranteed. Maintenance, technical faults or circumstances beyond reasonable control may affect availability. Important information about a proposed project should be confirmed directly with us.

Website information and these terms may be updated. The last-updated date identifies this version; changes do not retrospectively alter an existing project agreement. No ongoing website availability or support service level is created by these terms.

8. Responsibility and liability

Nothing in these terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Applicable statutory rights remain unaffected.

Subject to those protections, responsibility for loss arising from website use is determined under applicable law. We are not responsible for loss to the extent it is caused by your unlawful misuse of the site, or for losses that were not reasonably foreseeable as a consequence of our breach of a legal duty. This is not a blanket exclusion of responsibility for our own negligence or breach.

These terms do not impose a financial liability cap or seek to exclude all business losses. Liability for commissioned services must be addressed fairly in the separate project agreement and remains subject to applicable law.

9. Privacy

Our Privacy Policy explains enquiry information, lawful bases, service providers and your data protection rights. The enquiry checkbox acknowledges that notice; it is not blanket consent to processing or an opt-in to marketing. Please do not submit passwords, sensitive personal information or confidential third-party material through the website form.

10. Governing law and disputes

The intended governing law for these website terms is the law of England and Wales, with disputes subject to the courts of England and Wales. This provision is subject to confirmation of the actual legal operator and review before publication.

Nothing in this provision deprives consumers of mandatory protections or any right to bring proceedings in the courts of their home jurisdiction where applicable law provides it, including relevant rights in Scotland or Northern Ireland. Please contact us about a concern so it can be considered; this does not prevent you from exercising legal rights.

11. Contact

For website or terms questions, email hello@formadigital.uk. For new projects and consultations use sales@formadigital.uk; for existing-client support use support@formadigital.uk; for billing use accounts@formadigital.uk. These addresses feed the same business inbox.

The confirmed legal operator identity and contact address must be added to section 1 before publication. Contact by email does not remove that requirement.
